New Texas Roof Insurance Rules: What Homeowners Need to Know Before Selling


If you're thinking about selling your home in Texas, there is an important insurance trend that could affect both you and your future buyer: changes in how insurance companies handle roof claims.


For years, many Texas homeowners were able to replace their roofs after hail or storm events, even when the damage was primarily cosmetic. A common question from rental property owners is:




“Can you issue separate 1099s to each partner who owns the property?”


This situation often comes up when a rental property is owned by multiple investors, partners, or members of an LLC. While it may seem logical to divide the income among owners at the property management level, IRS reporting rules do not allow property managers to do this.


The 1099 Must Be Issued to the Legal Payee


For tax reporting purposes, a property manager must issue the 1099 to the legal entity or person listed as the payee on the W-9 form and management agreement.


That means if the property is owned by:




An LLC


A partnership


A trust


Or an individual owner




…the 1099 must be issued to that single entity or person, even if there are multiple partners behind that ownership.


Property managers report the total rent collected on behalf of the legal owner. We cannot split the income across multiple 1099 forms for different partners.


How Income Gets Divided Among Partners


If a property is owned by multiple investors, the division of income typically happens when the entity files its tax return.


For example:




An LLC with multiple members or a partnership will usually file a partnership tax return.


The accountant will allocate income to each partner based on their ownership percentage.


Each partner then receives a Schedule K-1, which reports their individual share of the income.




This process is handled by the entity’s CPA or tax professional, not the property management company.


What Property Managers Provide


Property managers provide documentation that helps make tax reporting easier, including:




Year-end 1099 forms


Owner statements showing income and expenses


Detailed financial records for the property




Many investors simply provide these documents directly to their CPA.


The Bottom Line


Even if a rental property has multiple partners or investors:




The 1099 is issued to the legal owner listed on the W-9


Income allocation between partners happens on the tax return


Partners typically receive their share through Schedule K-1 forms

Over 80 million Americans, or 33 of the population, have a criminal record. The country also has the sixth-highest incarceration rate in the world.


Many of these individuals will later become renters. The words &quot;criminal record&quot; shouldn't scare a landlord away, but they do need to look into what it contains.


Read on for several reasons why you should conduct a tenant criminal background check.


SAFETY AND SECURITY


Tenant screening helps you find the best tenants for your property. The first thing it should always do is determine if they'll be safe to have on your property.


Having a criminal record doesn't always make them dangerous, but it's important to have a record of their actions. It prevents you from letting in ones with a history of violent behavior.


They could harm other tenants. A property with a reputation for being unsafe is also unlikely to get any new applicants.


PROTECTING YOUR INVESTMENT


A comprehensive criminal check lets you look into the tenant's entire history. It lets you know what they were convicted for, when, and why.


Be careful about accepting tenants with a history of property damage or violent crimes. Letting them in puts you at risk of spending unnecessary time and money on repairs or even losing part of the property entirely.


REDUCING LIABILITY


Landlords are responsible for the health and safety of their tenants. You'll be liable for any damage they cause to property or tenants unless you perform a proper tenant criminal background check.


You're also legally required to let your tenant know what you're looking at during the screening process. Tell each applicant about every part of your screening checklist. Tell them that it includes checking their criminal record.


There are also federal laws to contend with. Fair Housing Laws prohibit landlords from denying tenants based on protected categories such as:




Race


Color


Religion


Sex


Handicap


Familial status


National origin




You can deny them because of the results of a criminal background check. You can't create a blanket policy where you deny anyone with a record unless you want to be hit with a discrimination lawsuit.


Look at the length and nature of each tenant's crimes individually instead. What did they do and how long ago was it?

Renting a property with multiple units is like joining a dorm in college. It can be a miserable or wonderful experience depending on the community.

Buying a house is the most fulfilling investment you’ll ever make, and it’s important to understand all the details. Read your purchase agreement carefully and discuss any disputes with the seller before signing.


The purchase agreement plays an essential role in helping you secure the home of your dreams. Keep reading to get an in-depth look at this document so you can use it to your advantage.


WHAT IS A PURCHASE AGREEMENT?


A purchase agreement states the terms and conditions of buying a home. It’s a legally binding contract that both parties must sign before it becomes valid.


COMPONENTS OF A PURCHASE AGREEMENT


Your purchase agreement should clearly state who’s buying and who’s selling. Besides these basic components, some contracts will also include additional clauses that address title insurance or warranties.

Don’t be afraid of the negotiation process. It’s a chance to learn more about the seller and their motivation, as well as assess what kind of deal makes sense for both parties.


If anything is excluded from the property, confirm that the exclusion is in your contract. For example, if there is no furniture included with the house purchase, the buyer should state this.


Finally, always include contingencies in your purchase agreement that offer both parties some flexibility. Alternative closing dates, for example, can be useful if you need more time to get your financing together.

This makes investing in residential real estate a smart bet. But, renting out property to tenants comes with legal and practical responsibilities—responsibilities more serious than other investments incur.


As a result, responsible landlords are increasingly seeking property management services.


WHAT IS PROPERTY MANAGEMENT?


Property management is the umbrella term for the regular work of overseeing and maintaining residential properties. A succinct property management guide instructs on how to:
